Orders / Sales Agreement
The information presented in the Online Store or, where Orders are placed using other means of distance communication, an electronic message confirming the content of the proposed Sales Agreement, constitutes an invitation to conclude an agreement within the meaning of Article 71 of the Civil Code, addressed by the Seller to Customers, and not an offer within the meaning of the Civil Code.
The Seller enables the placing of orders through the online store 24 hours a day, 7 days a week.
Orders can be placed by Users of the Online Store who have correctly completed the Registration Form on the Online Store's website. Orders can also be placed without the registration form. If the Customer does not have a user account, they must fill in a separate order form with the data necessary to conclude the sales agreement.
When placing an order, part of the procedure is also the Customer providing their personal data indicated in the order form as mandatory. Providing personal data marked as mandatory is voluntary, but necessary to place an order. Providing personal data not marked as mandatory is voluntary and is not necessary to place an order.
The order form must include data such as the Customer's first and last name and address, phone number and email address (e-mail), the recipient's details and the address to which the goods are to be delivered, if the ordered goods are to be delivered to an address other than the Customer's.
The Customer sends the Order to the Seller using the functionality of the Online Store provided for this purpose, which expresses the obligation to pay. A Customer who does not have an Account is required to accept the Terms and Conditions.
After the Order is placed, the Seller promptly confirms receipt of it and at the same time accepts the Order for processing. Confirmation of receipt of the Order and its acceptance for processing is made by the Seller sending the Customer an appropriate email to the Customer's email address provided when placing the Order, which contains at least the Seller's statements that the Order has been received and accepted for processing, and confirmation of the conclusion of the Sales Agreement. The Sales Agreement between the Customer and the Seller is concluded when the Customer receives the above email.
The total value of the order includes the price of the goods and the shipping costs.
The Sales Agreement is concluded in Polish.
If performance is impossible, and in other situations specified by law, the relevant provisions of the Civil Code may apply, in particular those concerning the obligation to promptly return the performance to the Consumer.

Product prices are given in Polish zloty (PLN) and include VAT.
The Customer can pay the price by:
- bank transfer to the Seller's bank account;

Detailed terms and conditions for making payments through electronic payment operators are available on the website of the given operator.
When paying through an electronic payment operator, the User should follow the instructions provided by the electronic payment operator in order to make the payment.
The Customer authorizes the Seller to issue a VAT invoice without the recipient's signature in electronic form (or another document confirming the sale in electronic form).
Shipping
Products are delivered to the address indicated by the Customer when placing the Order. Details can be found in our Shipping section at https://tea24.eu/.
The available methods of delivering the Product are presented to the Customer on the Online Store's website and when the Customer places the Order.
The available delivery methods may depend on the chosen payment method or the Product, and may change when several Orders are placed at the same time, in particular because of the Products or Additional Services they include.
Delivery of the Product to the Customer is subject to a charge, and the amount of the final fee may depend on the Product selected by the Customer. The Seller may, at a time of its choosing, set a minimum Order value above which delivery of the Products covered by the Sales Agreement is free. The Seller may provide that certain forms of delivery are free.
In the Product description on the Store's website, the Seller informs the Customer of the number of Business Days needed to process the Order and deliver it, as well as the amount of the fees for delivering the Product.
The delivery and order processing time is counted in Business Days.
The total waiting time for the Customer to receive the Product (delivery time) consists of the time needed by the Seller to prepare the Order for shipping and the time needed by the carrier to deliver the Product.
If the ordered Products have different delivery times, the longest time applies to the entire Order.
The risk of accidental loss or damage to the item passes to the Consumer upon delivery of the item to the Consumer.
The Consumer is advised to check the condition of the products as soon as possible after delivery. If defects are found, the Consumer is advised to contact the Seller by email: tea24.eu@gmail.com.
Right of withdrawal from the Agreement
Subject to para. 11 below, a Consumer who has concluded a distance agreement may withdraw from it without giving a reason and without incurring any costs other than those provided for by law, within 14 days from the date referred to in para. 6 of these Terms and Conditions.
To meet the deadline, it is sufficient for the Consumer to submit a statement to the Seller before it expires. The Consumer may submit any unambiguous statement informing the Seller of their withdrawal from the Sales Agreement / any other distance agreement concluded with the Seller. A statement of withdrawal from a distance agreement may be submitted, for example, in writing to: Hanna Vasileuskaya, ul. Kosynierow 14 lok 12, 05-270 Marki, or by email: tea24.eu@gmail.com.
In the event of withdrawal from a distance agreement, the agreement is considered not concluded.
If the Consumer chooses to withdraw from the Sales Agreement / any other distance agreement concluded with the Seller electronically, the Seller is obliged to send the Consumer confirmation of receipt of the statement of withdrawal from the distance agreement.
The Consumer may use the model withdrawal form, which constitutes Appendix No. 1 to the Terms and Conditions, but this is not mandatory.
The withdrawal period for the Sales Agreement begins on the day the Consumer, or a third party indicated by the Consumer other than the carrier, takes possession of the Product, and in the case of a Sales Agreement that:
- a) covers multiple Products that are delivered separately, in batches or in parts – from the day of taking possession of the last Product, batch or part, or
- b) consists of the regular delivery of Products for a fixed period – from the day of taking possession of the first Product.
In the case of other distance agreements, the period begins on the day the given agreement is concluded.
The Seller is obliged to promptly, and no later than within 14 days from the date of receiving the Consumer's statement of withdrawal from the agreement, refund the Consumer all payments made by them, including the cost of delivering the Product (except for additional costs resulting from the Customer's choice of a delivery method other than the cheapest standard delivery method available in the Online Store). If the Consumer has chosen a delivery method other than the cheapest standard delivery method available in the Online Store, the Seller is not obliged to refund the Consumer the additional costs incurred by them in an amount exceeding the cost of the cheapest standard delivery method.
The Seller refunds the payment using the same payment method that the Consumer used, unless the Consumer has expressly agreed to a different method of refund that does not involve any costs for them. If the Seller has not offered to collect the Product from the Consumer itself, it may withhold the refund of payments received from the Consumer until it has received the Product back or until the Consumer has provided proof of having sent it back, whichever occurs first.
The Consumer is obliged to return the Product to the Seller, or hand it over to a person authorized by the Seller to collect it, without undue delay and no later than within 14 days from the day on which they withdrew from the Sales Agreement, unless the Seller has offered to collect the Product itself. The Consumer bears all direct costs of returning the Product due to withdrawal from the agreement, i.e. in particular the costs of packaging, securing and sending the Product. To meet the deadline, it is sufficient to send the Product back before it expires. The Consumer returns the Product to the address: Hanna Vasileuskaya, ul. Kosynierow 14 lok 12, 05-270 Marki.
The provisions concerning the consumer set out in this section also apply, to agreements concluded from that date, to Customers who are natural persons concluding an agreement directly related to their business activity, where the content of that agreement shows that it is not of a professional nature for them. To determine whether such a customer has consumer rights in given circumstances, it should be verified whether the agreement is of a professional nature on the basis of the entrepreneur's entry in the Central Registration and Information on Business of the Republic of Poland.
[EXCLUSIONS FROM THE RIGHT OF WITHDRAWAL] The right to withdraw from a distance agreement does not apply to the Consumer in respect of agreements:
- in which the subject of the performance is a non-prefabricated Product, made to the Consumer's specification or serving to satisfy their individualized needs.
- in which the subject of the performance is a Product that spoils quickly or has a short shelf life;
- in which the subject of the performance is a Product delivered in a sealed package which, after opening, cannot be returned for health protection or hygiene reasons, if the package was opened after delivery;
Complaints procedure
The provisions of the Consumer Rights Act (chapter 5A) apply to sales agreements.
Complaints can be submitted in writing to: Hanna Vasileuskaya, ul. Kosynierow 14 lok 12, 05-270 Marki, or by email: tea24.eu@gmail.com.
The Seller will respond to the complaint within 14 days of receiving it. If the Seller does not respond within that time, the complaint is deemed to have been accepted.
A product is in conformity with the agreement if, in particular, its description, type, quantity, quality, completeness and functionality are in conformity with the agreement, and, for products with digital elements, also its compatibility, interoperability and the availability of updates, as well as its suitability for the particular purpose for which the consumer needs it, which the consumer notified to the Seller at the latest at the time of concluding the agreement and which the Seller accepted.
In addition, to be considered in conformity with the agreement, a product must: be fit for the purposes for which a product of that kind is normally used, taking into account applicable law, technical standards or good practices; be present in such quantity and have such features, including durability and safety, and, for products with digital elements, also functionality and compatibility, as are typical for a product of that kind and which the consumer can reasonably expect, given the nature of the product and public statements made by the entrepreneur, its legal predecessors or persons acting on their behalf, in particular in advertising or on the label, unless the entrepreneur proves that:
- it was not aware of the given public statement and, reasonably assessed, could not have been aware of it,
- before the conclusion of the agreement, the public statement was corrected under the conditions and in the form in which the public statement was made, or in a comparable way,
- the public statement did not influence the consumer's decision to conclude the agreement.
To be considered in conformity with the agreement, a product must also be delivered with the packaging, accessories and instructions that the consumer can reasonably expect, and be of the same quality as the sample or model that the entrepreneur made available to the consumer before the conclusion of the agreement, and correspond to the description of such a sample or model. For products with digital elements, the provisions of Art. 43k para. 3 and 4 and Art. 43l para. 4 of the Consumer Rights Act apply accordingly.
The Seller is not liable for a lack of conformity of the product with the agreement referred to above if the consumer was expressly informed, at the latest at the time of concluding the agreement, that a specific feature of the goods deviates from the conformity requirements set out in paras. 5 and 6 above, and expressly and separately accepted the lack of that specific feature of the product.
If the product is not in conformity with the agreement, the consumer may demand its repair or replacement. The Seller carries out the repair or replacement within a reasonable time from the moment it is informed by the consumer of the lack of conformity with the agreement, and without excessive inconvenience to the consumer, taking into account the nature of the product and the purpose for which the consumer purchased it. The costs of repair or replacement, in particular the costs of postage, transport, labor and materials, are borne by the Seller.
The consumer makes the product to be repaired or replaced available to the Seller. The entrepreneur collects the goods from the consumer at its own expense. The consumer is not obliged to pay for the ordinary use of the goods that were subsequently replaced.
If the product is not in conformity with the agreement, the consumer may submit a statement on reducing the price or withdrawing from the agreement when:
- the seller has refused to bring the product into conformity with the agreement in accordance with Art. 43d para. 2 of the Consumer Rights Act;
- the seller has failed to bring the product into conformity with the agreement in accordance with Art. 43d paras. 4–6 of the Consumer Rights Act;
- the lack of conformity of the product with the agreement persists despite the seller having attempted to bring the product into conformity with the agreement;
- the lack of conformity of the product with the agreement is so significant that it justifies a price reduction or withdrawal from the agreement without first using the remedies set out in Art. 43d of the Consumer Rights Act;
- it is clear from the entrepreneur's statement or from the circumstances that it will not bring the goods into conformity with the agreement within a reasonable time or without excessive inconvenience to the consumer.
The reduced price must remain in the same proportion to the price resulting from the agreement as the value of the product that is not in conformity with the agreement bears to the value of a product that is in conformity with the agreement.
The Seller refunds to the consumer the amounts due as a result of exercising the right to a price reduction without undue delay, no later than within 14 days from the date of receiving the consumer's statement on the price reduction.
In the event of withdrawal from the agreement, the consumer promptly returns the product to the Seller at the Seller's expense. The Seller refunds the price to the consumer without undue delay, no later than within 14 days from the date of receiving the product or proof of its return.
The consumer may not withdraw from the agreement if the lack of conformity of the product with the agreement is insignificant. It is presumed that the lack of conformity of the product with the agreement is significant.
The Seller is liable for a lack of conformity of the product with the agreement that exists at the time of its delivery and becomes apparent within two years from that time, unless the product's shelf life, specified by the entrepreneur, its legal predecessors or persons acting on their behalf, is longer.
It is presumed that a lack of conformity of the product with the agreement that became apparent before two years from the delivery of the product existed at the time of its delivery, unless proven otherwise or unless this presumption cannot be reconciled with the nature of the product or the nature of the lack of conformity.
The provisions concerning the consumer set out in this chapter also apply, to agreements concluded from that date, to Customers who are natural persons concluding an agreement directly related to their business activity, where the content of that agreement shows that it is not of a professional nature for them. To determine whether such a customer has consumer rights in given circumstances, it should be verified whether the agreement is of a professional nature on the basis of the entrepreneur's entry in the Central Registration and Information on Business of the Republic of Poland.
The Seller complies with the provisions of chapter 5B of the Consumer Rights Act with regard to agreements for the supply of digital content or a digital service. The Seller is liable for a lack of conformity with the agreement of digital content or a digital service supplied continuously, which occurred or became apparent during the period in which, under the agreement, they were to be supplied. That period may not be shorter than two years from the delivery of the goods with digital elements. It is presumed that a lack of conformity of the digital content or digital service with the agreement occurred during that time if it became apparent during that time.
Out-of-court complaint and redress mechanisms
The Seller informs that out-of-court methods of handling complaints and pursuing claims are available. Using them is voluntary and may take place only if both parties to the dispute agree to it.
Detailed information on resolving consumer disputes, including the Consumer's options for using out-of-court complaint and redress mechanisms and the rules of access to these procedures, is available at the offices and on the websites of county (municipal) consumer ombudsmen, the voivodeship inspectorates of the Trade Inspection, and at: https://www.uokik.gov.pl/pozasadowe_rozwiazywanie_sporow_konsumenckich.php
A Customer who is a Consumer has, for example, the following options for using out-of-court complaint and redress mechanisms: (1) a request for dispute resolution to a permanent consumer arbitration court; (2) a request for out-of-court dispute resolution to the voivodeship inspector of the Trade Inspection.
Pursuant to Regulation (EU) No 524/2013 of the European Parliament and of the Council of 21 May 2013, we inform you that at http://ec.europa.eu/consumers/odr/

The ODR platform is a website with a one-stop shop for consumers and traders seeking an out-of-court resolution of a dispute concerning contractual obligations arising from an online sales or service contract.
Content and reviews
When posting and sharing content, the Customer voluntarily distributes that content. Posted content does not express the views of the Seller and should not be identified with its activities. The Seller is not a content provider, but only an entity that provides the appropriate ICT resources for this purpose.
The Seller verifies Reviews using the email address that was used in the purchasing process or assigned to the user account.
Product reviews may be posted only for Products actually purchased in the Seller's Online Store and by a Customer of the online store who has actually purchased the reviewed Product.

The Customer consents to the Seller using, free of charge, the reviews or other content they have posted within the Store's Website.
The Seller does not post, or commission other entities to post, false reviews or recommendations from Customers in order to promote its Products, and does not publish sponsored reviews.
The Customer is prohibited from providing illegal content, meaning information that, in itself or by reference to an activity, including the sale of products, is not in compliance with the law.
The Seller informs that reviews posted by Customers are not subject to automated assessment for prohibited content.
The Customer is not entitled to:
- post, when using the services, personal data of third parties or disseminate the image of third parties without the permission or consent of the third party required by law;

The Customer declares that:
- they are entitled to use the economic copyrights, industrial property rights and/or related rights to, respectively, the works, subjects of industrial property rights (e.g. trademarks) and/or subjects of related rights that make up the content;
- the posting and making available, as part of the services, of personal data, image and information concerning third parties has been done lawfully, voluntarily and with the consent of the persons concerned;
- they consent to the published content being viewed by other Customers and the Seller, and authorize the Seller to use it free of charge in accordance with these Terms and Conditions;
- they consent to the creation of derivative works within the meaning of the Act on Copyright and Related Rights.
If the Seller determines that a review does not meet the conditions set out in the Terms and Conditions, it may take moderation measures, i.e. remove the review or refuse to publish it.
If a third party (another Customer or another person or entity) considers that a given review contains illegal content, that person may notify the Seller at the email address: tea24.eu@gmail.com.
The notification should contain:
- the name or business name and email address of the person or entity submitting the notification;
- a statement confirming the good-faith belief of the person or entity submitting the notification that the information and allegations contained in it are accurate and complete.
- an explanation of why the given review constitutes illegal content;

The Seller sends the notifier confirmation of receipt of the notification, provided that the notifier's email address has been given.
The Seller considers the notification within 14 days from the date of receiving it, objectively and with due diligence.
The Seller's decision may consist in removing the review or leaving it in the Store.
The Seller promptly notifies (the notifier and the person who posted the reported review) of its decision, together with the reasons. The decision may be appealed. The Seller considers the appeal within 14 days from the date of receiving it.
Force majeure clause
Neither party shall be liable for failure to perform any of its obligations if such failure is caused by an unforeseeable event beyond its control or an incident of force majeure, including but not limited to war, epidemic, flood, fire, storm, shortage of raw materials, transport strike, partial or total strike, or blockade. The party affected by such events must promptly notify the other party, no later than 14 calendar days after the occurrence of the said event.
The parties agree to work together to fulfill the obligation as best they can while such events continue.
This clause does not in any way limit consumer rights.
Personal data protection
The Seller collects and processes the personal data provided by Customers in accordance with applicable law and the Privacy Policy.
The Seller applies appropriate technical and organizational measures to ensure the protection of the personal data processed.
Additional explanations concerning the protection of personal data are contained in the “Privacy Policy” tab available on the Website.
Final provisions
The law applicable to agreements with Customers is Polish law. The United Nations Convention on Contracts for the International Sale of Goods, drawn up in Vienna on 11 April 1980, does not apply.
The choice of Polish law as the applicable law does not deprive Customers who are consumers of the protection granted to them by the law applicable in their place of habitual residence in the EU.
In matters not regulated by these Terms and Conditions, Polish law applies.
Any disputes arising between the Seller and a Customer who is a Business shall be submitted to the court competent for the Seller's registered office.
Each Customer will be informed of any changes to these Terms and Conditions by a notice on the home page of the Online Store, together with the effective date. Customers with an Account will additionally be informed of the changes at the email address they have provided. If a Customer with an Account does not accept the new content of the Terms and Conditions, they are obliged to notify the Seller of this within 14 days from the date of being informed of the change. Notifying the Seller of non-acceptance of the new content of the Terms and Conditions results in termination of the Agreement.
